Halligan’s departure, announced Tuesday, followed a November ruling that deemed her appointment invalid. The judge asserted that the district court, and only the district court, possessed the power to appoint an interim U.S. attorney following the previous officeholder’s exit. This decision immediately cast a shadow over her ability to function effectively.

The fallout was swift and deeply personal. Halligan described facing “baseless accusations” of dishonesty and being subjected to repeated, unusual demands from the court. She was forced to defend her presence on legal filings, diverting crucial time and resources away from pressing public safety concerns.

Adding to the complexity, the court didn’t simply invalidate her appointment; it actively treated it as disqualifying, removing her name from official documents. Yet, crucially, the court simultaneously failed to take the necessary step of appointing a replacement, despite its own legal justification for doing so.

This created a dangerous vacuum. The Executive Branch was told it lacked the authority to appoint anyone, while the Judiciary refused to exercise the power it claimed as its exclusive right. Halligan characterized the situation as a stark contradiction, now being challenged on appeal.

Former Attorney General Pam Bondi lauded Halligan’s service, emphasizing her dedication to prosecuting violent offenders and protecting the over six million residents of Eastern Virginia. Bondi characterized Halligan’s tenure as one of distinction and unwavering commitment.

Bondi strongly criticized what she described as a politically motivated obstruction, alleging that Democratic Senators deliberately used procedural tactics to prevent Halligan from continuing in her role. Despite facing “multiple, unnecessary legal obstacles,” Halligan reportedly stepped forward during a critical time for the nation.

Bondi expressed deep regret over Halligan’s departure, calling it a significant loss for the Department of Justice and the communities she served. She voiced confidence that Halligan would continue to contribute to the country in other capacities.

The circumstances surrounding Halligan’s exit were labeled “deeply misguided” by Bondi, who affirmed the Justice Department’s commitment to seeking a review of the decisions that she believes impede the department’s ability to ensure public safety. The legal battle, and its implications, are far from over.
