For two decades, Faye Bernstein dedicated her career to Minnesota’s Department of Human Services, diligently working in contract management and compliance. A quiet unease began to grow within her in 2018 and 2019, escalating from a sense of departmental sloppiness to a chilling realization: the system was dangerously vulnerable to widespread fraud.

Promoted to a lead position, Bernstein gained a comprehensive view of the contracts flowing through her division. What she witnessed was deeply troubling – conflicts and inconsistencies that screamed of potential abuse. She understood, with growing alarm, that the contracting processes lacked fundamental safeguards, leaving the door wide open for exploitation.

The scale of the potential fraud was staggering. Federal prosecutors now estimate that as much as $9 billion has been stolen through a network of deceptive fronts masquerading as legitimate daycare centers, food programs, and health clinics. A significant number of those implicated in the ongoing investigation are members of Minnesota’s Somali community.

Bernstein attempted to raise her concerns with her deputy director, but her questions were abruptly shut down. She was told, in effect, to cease her inquiries. Soon after, she experienced a pattern of retaliation, her responsibilities stripped away and her position repeatedly shifted within the department.

The internal culture, she described, prioritized obedience above all else. Human resources personnel explicitly instructed employees to follow directives from their supervisors without question, labeling any resistance as “insubordination” – even when those directives felt unlawful. This created a stifling environment where legitimate concerns were silenced.

Adding to the frustration, Bernstein began receiving a flood of emails from concerned citizens beginning in 2024, each one detailing allegations of the very fraud she had been warning about. The sheer volume of these warnings was astonishing, raising a disturbing question: had these public alerts been ignored?

The state’s DHS recently responded to the unfolding crisis, citing federal data that suggests Minnesota’s Medicaid program has a lower improper payment rate – just over 2.1% – compared to the national average of 6.1%. Officials also point out that this data predates the implementation of new fraud prevention measures.

Shireen Gandhi, the state’s interim human services commissioner, insists the department is committed to strengthening its internal controls and becoming a national leader in fraud prevention. She emphasizes ongoing efforts to identify and correct errors, signaling a renewed focus on accountability.

Despite her lifelong affiliation with the Democratic party, Bernstein is adamant that this is not a partisan issue. She stresses the fraud is real, a genuine crisis that demands immediate attention and a thorough reckoning. This isn’t manufactured outrage; it’s a devastating reality.

Bernstein’s story serves as a stark warning about the consequences of systemic negligence and the importance of fostering a culture of transparency and accountability within government agencies. Her courage in speaking out highlights the critical need for robust oversight and a willingness to address uncomfortable truths.
