A storm is brewing over the nation’s tax collection agency, with accusations of widespread abuse of power reaching the halls of Congress. A lawmaker has demanded a full investigation into the Bureau of Internal Revenue (BIR) following mounting complaints from businesses alleging a system rigged for personal gain.

The call for a congressional inquiry centers on the BIR’s authority to examine taxpayer records, specifically the issuance of Letters of Authority (LoA) – the official green light for audits. These LoAs have become the focal point of a scandal, with claims that the process has been corrupted into a lucrative scheme.

Alarming reports suggest a significant portion of funds collected through these audits – potentially as high as 70% – may be diverted into private hands, bypassing the national treasury. This isn’t simply about errors or inefficiencies; it’s a serious allegation of systemic theft.

Businesses are reporting a barrage of questionable audit requests, including demands for records from years already settled and fully paid. This aggressive tactic, they claim, is a thinly veiled attempt to pressure taxpayers into making unofficial payments.

The issuance of LoAs was briefly suspended in November amidst the growing outcry, but recently resumed as the government seeks to bolster revenue. This decision has reignited concerns that the underlying problems remain unaddressed.

The accusations paint a disturbing picture: inflated assessments negotiated down through secret “packages,” payments slipped into drop boxes, and even threats leveled against those who resist. Taxpayers describe a climate of fear and intimidation.

Government data reveals a dramatic increase in LoA issuance, with 82,228 issued in the first ten months of last year – nearly double the number from 2022. This surge raises questions about the scale and intent of the audits.

The lawmaker who initiated the call for investigation didn’t mince words, labeling the practices “extortion disguised as enforcement.” The proposed inquiry aims to dissect the BIR’s procedures, assess the effectiveness of the audit system, and implement safeguards against future abuse.

Beyond procedural changes, lawmakers are considering structural reforms, including harsher penalties for corrupt officials, to rebuild trust in the tax system. A comprehensive overhaul is deemed necessary to protect honest taxpayers.

The Senate is also taking up the issue, with hearings already underway. Simultaneously, a separate bill has been filed to increase the tax-exempt ceiling for employee bonuses and incentives, a move proponents say will alleviate the financial burden on workers.

These proposals, aimed at easing the tax burden on ordinary citizens, are presented as a complement to the demands for a fairer and more transparent tax collection system. The focus is shifting towards a system that encourages compliance through fairness, not fear.
