A wave of federal investigations has surged into local school policies, signaling a dramatic shift in the Justice Department’s focus. Investigations were launched Wednesday into three Michigan school districts, probing the inclusion of gender-related content in classrooms and access to intimate spaces. Simultaneously, the department moved to intervene in a contentious lawsuit challenging admissions and funding practices in Los Angeles.

The Civil Rights Division is scrutinizing Detroit Public Schools Community District, Godfrey-Lee Public Schools, and Lansing School District for potential inclusion of “sexual orientation and gender ideology” (SOGI) content across all grade levels. Investigators will determine if parents were adequately informed of their right to excuse their children from such instruction. A key concern centers on access to bathrooms and locker rooms, with a focus on whether districts adhere to biological sex designations.

Assistant Attorney General Harmeet Dhillon articulated a firm stance, emphasizing the department’s commitment to upholding parental rights and enforcing Title IX regulations. She asserted that a growing trend of integrating sexuality and gender ideology into public education must be halted, citing Supreme Court precedent affirming parents’ rights to guide their children’s upbringing.

Dhillon further emphasized Title IX’s role in safeguarding the “safety, dignity, and innocence” of students, specifically regarding access to single-sex facilities. The investigations will assess compliance with Title IX and a recent Supreme Court decision, while acknowledging that no conclusions have been reached at this stage. The districts under review receive substantial taxpayer funding, adding weight to the scrutiny.

In a separate but equally significant move, the Justice Department is seeking to intervene in a lawsuit against the Los Angeles Unified School District. The suit, brought by the 1776 Project Foundation, challenges the district’s Predominately Hispanic, Black, Asian, and Other (PHBAO) Program, a system that categorizes students by race and neighborhood demographics for funding and admissions.

The program designates neighborhoods with less than 30% White residents as “disadvantaged,” granting those schools additional funding, smaller class sizes, and preferential treatment in magnet school admissions. The department’s proposed complaint alleges that LAUSD effectively treats attending school with non-White students as a disadvantage, comparable to attending an overcrowded school.

Attorney General Pam Bondi underscored the fundamental principle of equal protection under the law, stating that treating Americans differently based on race is not merely a suggestion, but a constitutional imperative. Dhillon echoed this sentiment, declaring that students “should never be classified or treated differently because of their race,” labeling racial discrimination as unlawful and fundamentally un-American.

Federal officials argue that LAUSD’s desegregation program has become outdated and now violates constitutional principles. While the Michigan investigations are ongoing and the LAUSD case awaits a federal court decision, the Justice Department’s actions represent a clear signal of increased federal oversight in local school policies, sparking debate about parental rights, equal access, and the role of the federal government in education.

Los Angeles Unified School District acknowledged the pending litigation but reaffirmed its commitment to providing all students with access to enriching educational opportunities. Representatives from the Michigan districts have not yet issued public responses to the investigations.
