A former top advisor to a prominent public health figure now faces serious federal charges. David Morens, 78, was indicted by the Department of Justice on accusations of conspiracy against the United States, obstruction of justice, and falsifying records.
The indictment, unsealed in Maryland, alleges Morens actively worked to conceal information and destroy federal records. He is accused of collaborating with two unnamed co-conspirators to evade transparency through Freedom of Information Act (FOIA) and Federal Records Act requests.
Evidence suggests Morens routinely conducted official government business using a private email account. He allegedly sought advice from the National Institutes of Health’s FOIA liaison on methods to avoid scrutiny of his communications.
In a 2021 email, Morens described a system for bypassing FOIA requests, stating he could send sensitive information to his colleague via personal Gmail accounts or deliver it directly. He believed his colleague was “too smart” to allow problematic information to circulate.
Further emails reveal Morens claimed to have learned techniques to make emails “disappear” after a FOIA request was filed but before the search began. He also admitted to deleting earlier emails after forwarding them to his personal Gmail account.
Morens reportedly preferred using Gmail specifically to avoid his official NIH email being subject to frequent FOIA requests, particularly fearing scrutiny from The New York Times. This deliberate effort to shield communications raises serious questions about transparency.
The Acting Attorney General stated the allegations represent a “profound abuse of trust” during a critical period – the height of the global pandemic. The indictment claims Morens and his associates attempted to suppress differing viewpoints regarding the origins of COVID-19.
Beyond the alleged obstruction, Morens also oversaw the EcoHealth Alliance, an organization that directed substantial American taxpayer funds to the Wuhan Institute of Virology. This institute was involved in controversial gain-of-function research on coronaviruses.
