UMVA has learned that a high-stakes legal battle is unfolding between a cutting‑edge betting platform and state regulators, with implications that could reshape the reach of federal commodities law into gambling territory.

In a dramatic turn, the platform and Arizona’s gaming authorities have jointly petitioned the Ninth Circuit to put their appeal on hold, citing a swarm of related cases already pending before the same court.

The request follows heated oral arguments this past April, where the heart of the dispute—whether the Commodity Exchange Act grants the CFTC exclusive control over event contracts traded on federally regulated exchanges—was laid bare before the judges.

Both sides argue that a pause would allow the court to wait for decisions in three pivotal cases: KalshiEX, LLC v. Assad; North American Derivatives Exchange, Inc. v. Nevada; and Robinhood Derivatives, LLC v. Dreitzer. These rulings, they say, will illuminate the very questions at the center of their own appeal.

Under the current timetable, the platform’s opening brief is set for June 8. The proposed delay would hold briefing until 30 days after the pending cases reach verdict, ensuring that the arguments presented are as informed and relevant as possible.

The conflict began when Arizona’s Department of Gaming issued a cease‑and‑desist letter in May, accusing the platform of offering illegal event wagering without the required state license.

In response, the company filed a federal lawsuit in March, asserting that federal law preempts state regulation of contracts traded on Designated Contract Markets. The fight escalated quickly with emergency relief requests and a criminal indictment filed in state court.

The federal government joined the fray in April, filing a lawsuit to block Arizona from enforcing state gambling laws against exchanges deemed CFTC‑designated. Although a preliminary injunction was denied on procedural grounds, the same court later granted a federal injunction that halted Arizona’s criminal case.

Now, with Arizona’s appeal deadline set for July 6, both parties see a pause as a strategic move to streamline the legal process and avoid duplication of arguments across overlapping cases.
