US Department of Justice Warns California of Potential Lawsuit Over Glock Ban, Citing Second Amendment Concerns

The Department of Justice has warned California that it will file a lawsuit against state officials if they do not abandon plans to enforce a ban on certain handguns, arguing that the law violates the Second Amendment's right to bear arms. In a letter to California officials, it was stated that residents have the constitutional right to acquire and use modern handguns for self-protection. The letter emphasized that individuals should not be forced to use outdated models to ensure their safety.

The warning comes as California's Assembly Bill 1127, also known as the "Glock ban," is set to take effect on July 1. The law prohibits licensed firearms dealers from selling or transferring certain types of pistols, including those that can be modified with illegal aftermarket conversion devices. The law reclassifies semi-automatic pistols, such as Glocks, as "machinegun-convertible" due to their trigger mechanisms. People who already own these firearms are allowed to keep them, and sales to law enforcement agencies or the military are exempt from the restrictions.

The Assistant Attorney General for Civil Rights has approved the filing of a complaint in federal district court against California officials over the law. However, it was stated that the filing could be deferred if the state agrees to enter pre-suit negotiations. The negotiations would need to result in the state immediately ceasing enforcement of the law, acknowledging its unconstitutionality, and agreeing to a court-enforceable consent decree to prevent similar laws from being enacted in the future.

California officials have been given a deadline to agree to enter pre-suit negotiations. The Department of Justice hopes that the state will be willing to work towards a voluntary resolution of the matter. The lawsuit threat is an effort to protect the constitutional rights of California residents and ensure that they are not unfairly restricted from exercising their right to bear arms.
