California’s “No Vigilantes Act” specifically aimed to increase transparency during ICE operations. The law sought to prevent agents from concealing their identities with masks and required clear display of identification badges. The Justice Department initially filed a lawsuit against California, arguing the state law was unconstitutional. A district court judge, previously appointed by President Clinton, had already issued a temporary block on the law, agreeing with the federal government’s assessment of a Supremacy Clause violation.

This recent ruling from the Ninth Circuit expands upon that initial block, making it permanent. The court’s order explicitly states that California’s law attempted to “directly regulate the United States” in its performance of core governmental tasks, a move the Constitution forbids.

The decision has been met with celebration from those who championed the federal government’s position. A First Assistant US Attorney publicly hailed the ruling as a “huge legal victory,” emphasizing the unconstitutionality of the state’s attempt to control federal agents.

California now has the option to appeal the Ninth Circuit’s decision, potentially escalating the legal battle further. The outcome of any appeal could have lasting implications for the balance of power between state and federal governments regarding immigration enforcement and the authority to regulate federal officials.
