A sweeping overhaul of online gambling regulations is coming to New York, driven by Governor Kathy Hochul’s commitment to protect residents from the growing risks associated with betting platforms.

The proposed changes, unveiled alongside new rules from the state Gaming Commission, directly address concerns about underage gambling and the manipulative potential of industry practices. These aren’t simply suggestions; they represent a determined effort to proactively prevent harmful gambling behaviors before they take hold.

Governor Hochul emphasized the pervasive nature of mobile sports wagering, noting its accessibility to young people who may not fully grasp the potential consequences. Her plan centers on establishing robust safeguards to prevent those under 21 from participating and to shield gamblers from predatory tactics.

A key focus is closing loopholes that allow minors to access betting platforms, often through the accounts of others. Regulators are exploring a multi-layered approach, including enhanced age-verification systems, mandatory device registration, and even the use of biometric identification to ensure the bettor matches the account holder.

The proposals don’t stop at verification. Adults who knowingly allow a minor to gamble could face severe consequences, potentially including a complete ban from all forms of gambling throughout New York State – from lottery tickets to casino visits.

Beyond underage gambling, the plan tackles the use of artificial intelligence by betting companies. The state aims to prohibit operators from using AI to personalize promotions or suggest bets, recognizing the potential for these technologies to exploit vulnerable individuals.

A more aggressive system for identifying and intervening with at-risk gamblers is also being developed. Operators will be required to designate a “responsible gaming lead” to actively monitor user activity for warning signs of problem gambling.

Specific triggers, such as large deposits, frequent canceled withdrawals, or sudden increases in betting volume, will initiate a thorough review of a patron’s gaming patterns. This will lead to a tiered response system, starting with outreach and support tools.

Intervention could escalate to requiring bettors to view educational content before continuing, and ultimately, to temporary or even permanent account suspensions if problematic behavior persists. Direct staff intervention will be a crucial component of this process.

State officials and advocates highlight a growing concern about the normalization of gambling, particularly among young people. The sheer ubiquity of sports wagering, and its constant presence in the lives of impressionable youth, is driving the need for these comprehensive protections.
