Former Representative Louie Gohmert has publicly condemned the actions of ex-Special Counsel Jack Smith, alleging a disturbing overreach into his personal communications. Gohmert claims Smith’s investigation targeted his private phone records, a move he believes fundamentally undermines the carefully constructed balance of power envisioned by the nation’s founders.

The allegations stem from a recently revealed document shared with Senators Chuck Grassley and Ron Johnson, detailing Smith’s “Arctic Frost” probe into the January 6th, 2021 Capitol riot. This document reportedly shows a request for toll records related to Gohmert’s personal cell phone, spanning from November 2020 to January 2021, alongside those of then-House Speaker Kevin McCarthy.

Gohmert expressed outrage, comparing Smith’s actions to a “witch hunt” and asserting a blatant disregard for the Fourth Amendment. He argued the investigation lacked the necessary probable cause and specific justification required for such intrusive measures, exceeding the boundaries of legal authority.

The core of Gohmert’s concern isn’t simply about his own privacy, but the chilling effect this could have on vital communication with sources within the Justice Department and FBI. He explained that individuals sharing concerns about potential wrongdoing within these agencies rely on confidentiality, a trust jeopardized by the seizure of his records.

He fears this practice could stifle internal reporting of misconduct, effectively silencing those who might otherwise come forward with crucial information. Gohmert emphasized the importance of a “wall” between Congress and executive branch investigations, a principle he believes has been dangerously eroded.

While deeply critical of Smith’s actions, Gohmert voiced confidence in the current leadership of the Justice Department and FBI. He expressed hope that any potential crimes committed during the investigation will be thoroughly examined and, if warranted, prosecuted according to the law.

Former Speaker Kevin McCarthy has vowed to pursue legal action against Smith, denouncing the investigation as a politically motivated weaponization of the Justice Department. He believes the attempt to access the phone records of members of Congress represents a severe abuse of power demanding accountability.

This revelation is not isolated. Reports indicate Smith’s team also tracked the private communications of numerous Republican senators, including Lindsey Graham, Marsha Blackburn, and others, subpoenaing major telephone providers to gather the data. The focus was reportedly on communications surrounding the January 6th events.

Smith’s legal team has defended the data collection as “entirely proper” and consistent with Justice Department policy, claiming it was narrowly tailored to a four-day period surrounding the Capitol riot. However, concerns remain regarding the scope and justification of the probe.

The FBI has acknowledged the sensitivity of the “Arctic Frost” case, designating it as “prohibited” and committing to transparency in its review. This ongoing investigation promises to shed further light on the extent of Smith’s actions and their potential implications for the separation of powers.
