Flannery, designed for lawyers and judges to gather and discuss legal matters. A federal judge posed questions to the justices as part of a panel discussion.

The core of the disagreement centered on the Court’s handling of emergency appeals during the Trump administration. Justice Jackson, known for her liberal stance and frequent dissents, voiced concerns about a perceived pattern. She argued the administration was effectively creating policy and demanding immediate implementation, even before legal challenges could be fully resolved.

Despite their disagreement on this specific issue, the justices found common ground elsewhere. Both Kavanaugh and Jackson unequivocally condemned the rising tide of threats against judges, asserting that such intimidation has no place in a just society. This shared concern underscored a fundamental principle they both uphold.

Kavanaugh, appointed in 2018, has generally aligned with the Court’s conservative majority. Jackson, appointed in 2022, represents a progressive voice and has, at times, found herself diverging even from her fellow liberal justices. This dynamic highlights the complex interplay of ideologies within the highest court in the land.

The exchange, while unusual in its public nature, offered a glimpse into the internal tensions and debates shaping the Court’s decisions. It revealed a willingness to engage in direct, if carefully worded, disagreement, even amidst the expectation of decorum and collegiality.
