The grainy CCTV footage captured a heartbreaking scene: a tiny boy, Noah Sibanda, being placed inside an indoor tepee for his afternoon nap. It was December 9, 2022, a day that would shatter a family and expose a chilling pattern of negligence.

More than two hours passed with Noah unchecked, lying face down in the fabric enclosure. When staff finally discovered him, he was unresponsive. A desperate rush to the hospital followed, but it was too late. Noah, just fourteen months old, was pronounced dead.

The prosecution revealed a disturbing practice within the nursery’s baby room: routinely covering children’s faces to get them to sleep. Kimberley Cookson, the nursery worker who placed Noah in the tepee, admitted she believed it was “fine” to obstruct the children’s breathing.

Noah’s mother, Masi Sibanda, delivered a devastating victim impact statement. She described her son’s birth as “a prayer answered,” a source of profound peace in her life. The trust she placed in the nursery staff, she now realizes, was tragically misplaced.

“I handed Noah over to the people who killed him,” Masi stated, her voice heavy with grief. “Because of this I cannot forgive myself and consequently will never forgive the defendants.” She painted a harrowing picture of the nursery as a place where staff were “playing Russian roulette with our children’s lives.”

Her final memory of Noah is etched in pain: holding him in the hospital, whispering promises of home, knowing he wouldn’t open his eyes. A vibrant, gentle boy, just beginning to walk and speak, was stolen from her arms.

Noah’s father, Thulani, echoed the unbearable loss. “My son died…because of the gross negligence of someone who was trusted to care for him.” He spoke of an immeasurable void, a future robbed of the joy of watching his son grow.

The court heard that the nursery’s sleeping routines were exceptionally dangerous, creating risks of overheating and exhaustion. Cookson’s negligence was described as “truly exceptionally bad,” a profound failure of care.

Deborah Latewood, the nursery owner, has also admitted fault, acknowledging she should have been aware of the dangerous practices, even if she wasn’t directly informed. Both Cookson and Latewood were visibly distressed as the damning CCTV footage was presented in court.

Masi Sibanda has paid tribute to her 14-month old son Noah who tragically never came home from nursery on December 9 2022.

The case continues, a stark reminder of the devastating consequences when trust is betrayed and the most vulnerable among us are left unprotected. It’s a tragedy that has left a family shattered and a community grappling with the weight of unimaginable loss.
